TULSA, Okla. (AP) — Attorneys for one of two men accused of gunning down three black people in April want the prospective trial judge off the case because he signed off on their client's arrest warrant.
Defense attorneys and a prosecutor met in private Thursday morning before District Judge Kurt Glassco to argue a Rule 15 motion — the legal process of seeking to remove a judge or have the case transferred.
Glassco signed the arrest warrant for accused shooter Jake England.
England and Alvin Watts are scheduled for an Oct. 22 arraignment before Glassco after a district judge ruled Tuesday that there was enough evidence to bind the men over for trial.
Glassco denied the Rule 15 motion. Now lawyers for England must file a written motion seeking Glassco's ouster.
